    This Privacy Policy applies to the information you provide to us when you visit SurveyJunkie.com (the “Website”) or participate in any Survey Junkie panel or subpanel (“Panel”). Please read this policy carefully to understand our information practices. By using this Website or any of the services offered on or through the Website, you are agreeing that you have read, understand, and accept the practices described in this Privacy Policy.

    This Privacy Policy sets forth the collection, use and disclosure of personal data or personally identifiable information (“Personal Data”) and other information by Survey Junkie in connection with Survey Junkie's Services (as defined herein). Survey Junkie's Services provide you with the opportunity to join a Panel (as defined herein), participate in surveys (whether as a Panel member or a non-Panel member), use the websites associated with the Panels, and receive and redeem rewards and incentives, including, without limitation, sweepstakes entries, offered in connection with Panel membership and/or the completion of surveys (collectively “Services”). Registration with, use of, and access to Survey Junkie's Services is subject to Survey Junkie's Panel Terms and Conditions. 

    Your use of Survey Junkie's Services is completely voluntary and therefore Survey Junkie's processing of your Personal Data in connection with the Services and this Privacy Policy is with your consent. Survey Junkie strives to conform its privacy practices to applicable laws, codes, and regulations. For clarification, except for Panels that have a separate privacy policy, this Privacy Policy applies to all of Survey Junkie's survey research Panels, including, without limitation, Survey Junkie (each a “Panel” and collectively the “Panels”). All references in this Privacy Policy to Survey Junkie include Survey Junkie and its subsidiary and affiliated companies. All references to “us” or “we” refer to Survey Junkie.

Survey Junkie Member and Non-Member Privacy Policy

This Privacy Policy applies to the information you provide to us when you visit SurveyJunkie.com (the “Website”) or participate in any Survey Junkie panel or subpanel (“Panel”). Please read this policy carefully to understand our information practices. By using this Website or any of the services offered on or through the Website, you are agreeing that you have read, understand, and accept the practices described in this Privacy Policy.

This Privacy Policy sets forth the collection, use and disclosure of personal data or personally identifiable information (“Personal Data”) and other information by Survey Junkie in connection with Survey Junkie's Services (as defined herein). Survey Junkie's Services provide you with the opportunity to join a Panel (as defined herein), participate in surveys (whether as a Panel member or a non-Panel member), use the websites associated with the Panels, and receive and redeem rewards and incentives, including, without limitation, sweepstakes entries, offered in connection with Panel membership and/or the completion of surveys (collectively “Services”). Information You Provide

We collect information from Panel members during and after registration, including, without limitation, during participation in a survey and in connection with the receipt and redemption of rewards and incentives. Information may be collected in various ways, including inquiry forms, registration forms, surveys, and contests. Survey Junkie collects additional data included in your member profile you submit voluntarily. When you sign up for a Panel you will be asked to provide certain Personal Data and demographic information, including but not limited to your name, address, telephone numbers, email address, date of birth, racial and gender information.

In addition to the collection of Personal Data mentioned above, during and subsequent to the registration process, you may be asked to voluntarily provide or disclose Sensitive Data. “Sensitive Data” means Personal Data that discloses or reveals health and medical conditions, sexual orientation or sexual life, political opinions/views, race/ethnic origin, religious and philosophical beliefs and trade-union membership. Sensitive Data is used to target survey opportunities to you. You may refuse to answer certain questions or discontinue participation at any time.

When you join a Panel, we ask you to provide us with information such as your name, telephone number, and email address. We may use this information to send you a test email or text message, or make a test call and to confirm your identity. If you use Facebook to sign up, Facebook may share some of the information that you have provided to them with us. When you participate in surveys, you may be asked for your personal opinions, as well as demographic information, such as your age, type of job, and household composition.

When you redeem points, we ask you to provide us with your PayPal account information, including your PayPal email address. If you earn more than a certain amount of money on Survey Junkie, we may be required by law to mail you a form to obtain your social security number, and send you a form with your name, social security number, and amount of money we have paid you for government tax reporting purposes.

In order to provide high quality service and to protect our members and the Website, we take steps to make sure that Survey Junkie members provide honest and accurate information about themselves and to all survey questions to the best of their ability. These steps may include sending you a text message or email to confirm your contact information or asking you to provide personal information through security questions to help us verify your identity before you can redeem your points for rewards. Please contact support if you have any questions.

Information Collected Through Automated Means

We may also collect certain information automatically, such as information about: (i) your device or computer and its capabilities, including, but not limited to, the operating system, IP address, device carrier, device type, time zone, network status, browser type, browser identifier, location and other information that alone or in combination may be used to uniquely identify your device or computer; and (ii) your activities in connection with Survey Junkie Services, including, without limitation, survey data and responses, and reward, incentive, and/or sweepstakes information. Specific examples of this information, and the technology that collects it, are below:

Cookies: Cookies are small information packets sent by web servers to web browsers, and stored by the web browsers.  The information is then sent back to the server each time the browser requests a page from the server, which enables a web server to identify and track web browsers.  There are two main kinds of cookies: session cookies and persistent cookies. Session cookies expire when you close your browser. Persistent cookies remain on your device or computer indefinitely until deleted. We may use session and persistent cookies for several purposes including, without limitation, to provide a better survey experience, quality control, validation, to enable or facilitate survey participation, tracking of completed surveys or other completed actions, and for fraud detection and/or prevention. Cookies help us recognize your browser and capture and remember certain information that you previously shared with us, such as your setting preferences. In order to use Survey Junkie, you must have cookies enabled on your browser.

Use of Cookies

The following types of cookies are used on the Website, for the following purposes:

Web Cookie: Web cookies to track the use of this website from the same browser on the same machine. This information will be stored and used anytime we see the same browser.

Adobe Flash Cookie: Adobe Flash cookies to track the use of the Website on the same machine from different browsers.  This information will be stored and used anytime we see the same device.

Microsoft Silverlight Cookie: Microsoft Silverlight cookies to track the use of the Website on the same machine from different browsers.  This information will be stored and used anytime we see the same device.

Refusing cookies: Most browsers allow you to refuse to accept cookies.  In Internet Explorer, you can refuse all cookies by clicking “Tools”, “Internet Options”, “Privacy”, and selecting “Block all cookies” using the sliding selector.  In Firefox, you can adjust your cookies settings by clicking “Tools”, “Options” and “Privacy”.  In order to use Survey Junkie, you must have cookies enabled on your browser.

Log Files: We may automatically gather and store certain information in log files, including, without limitation, data available from your web browser, including, without limitation, IP Address, browser type, Internet service provider, pages you visit, referring/exiting pages, operating system, date/time stamp and click stream data.

Digital Fingerprinting: Generally, digital fingerprinting assigns a unique identifier to your device or computer based upon the device’s or computer’s technical settings, characteristics and IP Address. We use digital fingerprinting technology for quality control and validation purposes and fraud detection and/or prevention, including, but not limited to, identifying duplicate or fraudulent respondents.

Do Not Track: We allow third-party companies to collect certain non-personally identifiable information when you visit our web site. These companies may utilize cookies, pixels or other technologies to collect and use non-personally identifiable information (e.g., hashed data, click stream information, browser type, time and date, subject of advertisements clicked or scrolled over) during your visits to this and other web sites in order to provide advertisements about goods and services likely to be of greater interest to you. Information Collected from Third Parties

We may obtain personal and demographic information from third parties, including, but not limited to, information services bureaus. We may use the personal and demographic information for various purposes, including, without limitation, data validation, data append and fraud detection purposes.

How We Use Your Information

In addition to other purposes set forth in this Privacy Policy, we use information collected through Survey Junkie Services as follows: (i) to communicate with you regarding your membership with a Panel; (ii) to communicate with you regarding your participation in a survey(s); (iii) to tailor survey opportunities to you; (iv) to send you notifications of survey opportunities; (v) to comply with any and all legal obligations, including, without limitation, tax obligations; (vi) to administer and manage our reward and incentive programs and fulfill your requests for rewards and incentives; (vii) to facilitate your entry into sweepstakes and promotions and communicate with you regarding such entries (viii) to update our records; (ix) to comply with any data suppression obligations or requirements; (x) for identity verification and fraud detection and/or prevention purposes; and (xi) as otherwise permitted under to this Privacy Policy or as otherwise authorized by you.

Communications You Will Receive

We or our agents, processors, vendors or subcontractors may contact you or communicate with you as follows via email communications for the purpose of: (i) sending you survey invitations, (ii) communicating with you regarding your survey participation (past, present and/or future),(iii) communicating with you regarding reward or incentive information, inquiries, and redemption, (iv) communicating with you regarding sweepstakes or prize draw promotions, (v) sending you newsletters, (vi) sending you notices required to be provided under this privacy policy or required by law, (vii) communicating with you regarding promotions, (viii) responding to inquiries received from you, and (ix) sending you communications to confirm your identity and for fraud detection and prevention purposes.

By agreeing to become a Panel member, you agree to receive invitations to participate in surveys. You may unsubscribe from Panel membership at any time, see “How to Opt Out" below. 

How we Share Personal Information and Other Information Collected with Third Parties

We may disclose personal information and other information collected to third parties as follows:

  1. With your consent, other than your consent to the processing and sharing described in this Privacy Policy and specifically this section.
  2. Under applicable law or in response to a subpoena or an order of a court or government agency.
  3. To establish, exercise, or defend legal claims of an individual or Survey Junkie.
  4. To establish or exercise our legal rights.
  5. If we believe disclosure is necessary to investigate, prevent, or take action regarding illegal activity, suspected fraud or other wrongdoing.
  6. To protect and defend the rights, property, or safety of our company, our employees, our users, or others; or to enforce Panel terms of use or other agreements or policies.
  7. In connection with a corporate change such as a merger, our acquisition by another company, or a partial or total sale of our assets.
  8. To authorized agents and/or vendors and subcontractors and clients, partners, who are providing services, including, without limitation, data append services, data validation services, fraud detection and/or prevention services, database-matching services, coding services, data segmentation services, and reward, and incentive related services, as well as market research partners that provide surveys.
  9. Your information may be shared with third parties in aggregate form. Aggregated data does not include personally identifiable information. This means that your survey responses may be combined with the responses of others who participate in surveys and those gathered responses are reported to the third party that commissioned the study.
  10. As otherwise permitted under this Privacy Policy.

How Your Privacy Is Protected

We use the latest security measures to protect against the loss, misuse and alteration of data. Access to all user information is restricted. Web servers and databases are housed and maintained in secure locations and protected by firewalls. We pride ourselves on updating and maintaining our security and privacy practices to ensure that your personal information remains protected at all times.

Special Note About Children

We believe that it is important to protect the online privacy of children. We carefully consider both privacy issues and parental concerns in connection with surveys involving individuals under the age of eighteen (18). Accordingly, We adhere to applicable laws and industry codes pertaining to the protection of children's privacy. If We become aware that it we inadvertently collected Personal Data from anyone under such age thresholds, We would promptly delete such Personal Data.

Our Services are not designed or intended for use by any individual under the age of thirteen (13) and We do not knowingly collect Personal Data from anyone under the age of thirteen (13). If We become aware that we inadvertently collect Personal Data from anyone under such age thresholds, we will promptly delete such Personal Data. Parents, guardians or other persons with parental rights are encouraged to contact us, as set forth below, to discuss this Privacy Policy and their rights to access, review, correct, delete or object to the processing of Personal Data of or about their child or children.

We reserve the right, at any time and without notice, to add to, change, update or modify this privacy policy simply by posting such change, update or modification on the website. Any such change, update or modification will be effective immediately upon posting on the website.

We reserve the right, at our discretion, to modify our privacy practices and update and make changes to this Privacy Policy at any time. We encourage you to refer to this Privacy Policy on an ongoing basis. This Privacy Policy is current as of the “Updated” date which appears at the top of this policy. We will treat Personal Data in a manner consistent with the Privacy Policy under which it was collected, unless we have your consent to treat it differently. Applicability and Agreement

These Terms and Conditions (these “Terms”) govern and apply to your use of Survey Junkie panels and survey-related services, including, without limitation, (1) membership of a Survey Junkie panel or subpanel, including, without limitation, the Panel (“Panel”), (2) use of and/or access to any Panel website (“Website”) (3) participation in any survey or study offered, provided, hosted, or administered by or through the Survey Junkie Panel, and (4) your eligibility for, and/or redemption of, rewards, incentives, and prizes offered for certain actions and activities, including, without limitation, successfully completing surveys (collectively, the “Services”). 

All references in these Terms to “Us” or “We” refer to Survey Junkie.

These “Terms” or “Agreement” constitute a legally binding agreement between you and Survey Junkie. By signing up, accessing, using, and/or participating in the Services you hereby expressly agree to comply with, and be bound by, these Terms. 

Survey Junkie reserves the right to refuse, restrict, prohibit, or reject your access to, use of, and/or participation in the Services, at any time and for any reason.

Please read the following Terms of Use carefully before using any of the services available on the Website (“Service”). Your use of the Service constitutes your agreement to be bound by this Agreement. THIS AGREEMENT ALSO INCLUDES A MANDATORY ARBITRATION CLAUSE AND CLASS ACTION WAIVER. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICE.

Membership Eligibility

Panel membership is generally open to individuals who satisfy the requirements for membership, including, without limitation, the minimum age requirement of 18 years of age. We only allow one member per unique email address. Members are not permitted to create more than one Survey Junkie account. Survey Junkie may refuse to provide the Services to anyone, at any time and for any reason or no reason.

Use of the Services

The Services are for personal, non-commercial use. You may use the Services only when and as available. Survey Junkie reserves the right to change, modify, or eliminate, and/or restrict or block access to, all or any part of the Services, without notice, at any time, for any reason or no reason.

Survey Junkie provides Panel members with the opportunity to participate in surveys. Participation in surveys is voluntary. By agreeing to become a Panel member, you agree to receive invitations to participate in surveys. You may unsubscribe from Panel membership at any time, see Section 12 "Opt Out Policy" below. 

Panel Registration and Passwords

In order to register as a Panel member, you must register with or for the Panel and provide certain personal information. Panel members are required to truthfully provide all information. Survey Junkie reserves the right to restrict or prohibit your use of, access to, and/or participation in the Services if you provide, or Survey Junkie reasonably suspects that you have provided, information that is untrue, inaccurate, not current, or incomplete.

Survey Junkie will either: (i) issue a user name and password to a Panel member, or (ii) permit a Panel member to create his/her own user name and password. Panel members are solely responsible for the security of their user names and passwords and will be solely liable and responsible for any use, whether authorized or unauthorized, of their membership accounts.

Panel membership is specific to the individual who registers for membership with the Panel.  

You acknowledge that you are accessing, using, and/or participating in the Services in the capacity of an independent contractor, and no agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship is intended or created by this agreement.

Unauthorized Uses

You agree not to: (i) use spiders, robots or other automated data mining techniques to catalog, download, store, or otherwise reproduce or distribute data or content available in connection with the Services, or to manipulate the results of any survey, prize draw, or contest; (ii) take any action to interfere with any Website or an individual's use of any Website, including, without limitation, by overloading, “flooding”, or “crashing” any Website; (iii) send or transmit any viruses, corrupted data, or any other harmful, disruptive, or destructive code, file, or information, including, without limitation, spyware; (iv) collect any personally identifiable information of or about any other user of the Services; (v) send unsolicited emails, including, without limitation, promotions and/or advertising of products or services; (vi) open, use, or maintain more than one (1) membership account with a Panel; (vii) forge or mask your true identity; (viii) frame a portion(s) of any Website within another website or alter the appearance of any Website; (ix) establish links from any other website to any page of, on, or located within any Website or to the Services, without the prior express written permission of Survey Junkie; (x) post or transmit any threatening, libelous, defamatory, obscene, pornographic, lewd, scandalous, or inflammatory material or content or any material or content that could otherwise violate Applicable Laws (as defined herein); (xi) impersonate any person or entity or misrepresent your affiliation with a person or entity; (xii) send multiple emails from the referral function to the same email address or continue to send emails through the referral function after a recipient has requested not to receive further emails; (xiii) create more than one Survey Junkie account; (xiv) attempt to inflate your points by circumventing or otherwise compromising our systems;(xv) engage in any fraudulent activity, including, without limitation, speeding through surveys, taking the same survey more than once, masking or forging your identity, submitting false information during the registration process, submitting false or untrue survey data, redeeming or attempting to redeem rewards, prizes, and/or incentives through false or fraudulent means, and tampering with surveys; (xvi) reverse engineer any aspect of the Services or do or take any act that might reveal or disclose the source code, or bypass or circumvent measurers or controls utilized to prohibit, restrict or limit access to any webpage, content or code, except as expressly permitted by Applicable Laws; (xvii) engage in any criminal or illegal act(s); (xviii) use Restricted Content (as defined herein) in violation or breach of these Terms; or (xx) encourage and/or advise any individual, including, without limitation, any Survey Junkie, vendor or subcontractor employee, to commit any act(s) prohibited hereunder. 

When using the Service's email referral function, if you are notified by us that a person has requested to “opt out” of receiving emails from Survey Junkie, you may not send further emails to that person's email address.

You acknowledge and agree that Survey Junkie will fully cooperate with all legal disclosure request(s) (e.g. court order or subpoena).

Restricted Content

In connection with your use of, access to, and/or participation in the Services, you may have the opportunity to review or access confidential and proprietary information, materials, products, and content (“Restricted Content”) belonging to Survey Junkie and/or the clients, partners and/or licensors of Survey Junkie surveys and services. Restricted Content is and shall remain the sole and exclusive property of the owner of the Restricted Content. In no event shall you obtain or receive any right, title, and/or interest in or to any Restricted Content. You agree to protect the confidentiality and secrecy of the Restricted Content and you agree not to modify, copy, reproduce, republish, display, transmit, distribute, reverse engineer, create derivative works of, decompile, or otherwise use, alter, or transfer Restricted Content without the prior express written consent of Survey Junkie. You acknowledge and agree that Restricted Content may be subject to, and protected by, intellectual property laws, regulations, and codes. You further acknowledge and agree that if you breach or otherwise violate the restrictions, limitations, and prohibitions contained in this Section, in addition to any other rights or remedies available to Survey Junkie, Survey Junkie reserves the right to terminate, prohibit or restrict your use of, access to, and/or participation in the Services.   

User Content

You are solely liable and responsible for all content, materials, information, and comments you use, upload, post or submit in connection with the Services (“User Content”). You are solely responsible for all third party approvals, consents, and/or authorizations required for User Content. If you submit User Content, the User Content may become publicly available and may be shared with third parties including, without limitation, Survey Junkie's clients, clients of Survey Junkie's clients, and third party service providers. User Content should only include audio, video, images, or the likeness of the individual submitting the User Content and should not contain copyrighted or trademarked content or material of any third party. User Content should not include audio, video, images, or the likeness of anyone other than the user. You will not receive compensation for any User Content.

By using, uploading, posting, or submitting User Content in connection with the Services, you hereby grant to Survey Junkie a perpetual, irrevocable, unlimited, transferrable, sub-licensable, world-wide, royalty free, right and license to edit, copy, transmit, publish, display, create derivative works of, reproduce, modify, distribute, and otherwise use, modify, or distribute your User Content in any manner, without compensation or notice.   

You are solely responsible for the User Content. Survey Junkie does not and cannot review all User Content and Survey Junkie is not responsible for the User Content. Survey Junkie reserves the right to delete, move, or edit User Content, that is, in Survey Junkie's sole discretion, deemed to: (i) violate these Terms, (ii) violate copyright or trademark laws, or (iii) be abusive, defamatory, obscene, or otherwise unacceptable. 

License Grant

When you use the Services or a Website, we grant you a, personal, non-exclusive, revocable, limited license to use our Services. You acknowledge that we maintain all right, title, and interest in Services or Website. This license may be terminated if you violate any provisions listed in this Agreement or our Privacy Policy. Additionally, this license may be terminated if you are engaged in any activities that we determine, in our sole discretion, may damage the rights of Survey Junkie or if your activities are in violation of any applicable laws.

Rewards Programs

In connection with your use of the Services, you may have the opportunity to earn rewards, incentives, and entries into prize draws or sweepstakes. Information, official rules, and terms and conditions for rewards, incentives, and prize draws or sweepstakes may be available on the Panel Website, at the beginning or end of a survey, in survey invitations, on the website(s) for redeeming rewards, incentives, and prizes, and/or may be described in any newsletter or other communication distributed or published by Survey Junkie.

You may redeem your points for rewards, including, without limitation, through Paypal and gift cards. A minimum number of points may be required for redemption. A valid Paypal account is required for redemption of points via Paypal. Survey Junkie reserves the right to verify the identity of Paypal account holders and withhold payment in its sole discretion, if it believes that the identity of the Paypal account holder differs from the Survey Junkie user; if it believes the user has violated this Agreement; or if it believes that the user has violated federal, state, or local law. Survey Junkie is not liable for the functionality of Paypal or other third parties that provide services through which a user may redeem points.

Rewards, incentives, and prizes are non-transferrable.

Profile Updates

Panel members agree to promptly notify Survey Junkie member services team of any changes in or to information contained in their member profile. Panel members agree to review and update, as necessary, membership profiles no less frequently than once every six (6) months. A Panel member may update, correct, and/or delete information contained in his or her membership profiles by: (i) accessing his or her Panel membership account; or (ii) sending an email to the appropriate Panel member services team for the appropriate Panel.

Opt-Out Policy

Panel members may opt-out from using the Services (including, without limitation, from receiving newsletters or communications), at any time, by: (i) following the unsubscribe procedures described on the Website or contained in any email received from the Survey Junkie; or (ii) by sending an email to the Panel member services team. Survey Junkie shall use reasonable efforts to read and respond to each email request within a reasonable period of time after receipt. Upon termination, a Panel member's contact information will be removed from any further communication or contact lists. Please allow a few days for the complete removal of contact information from Survey Junkie's communication or contact lists for the applicable Panel; during which period the member may receive communications which were created or compiled prior to termination. Please see the Survey Junkie Privacy Policy for information on how Survey Junkie handles information and data following an unsubscribe, termination, or opt-out request (“Survey Junkie Privacy Policy”).

Third Party Websites

In connection with your use of the Services, you may be able to voluntarily link or connect to websites maintained and/or operated by third parties (“Third Party Websites”), such as participating in surveys conducted on third party websites. Survey Junkie does not endorse any Third Party Website nor any products, services, and/or opportunities advertised, offered and/or sold by, through or in connection with any Third Party Website (“Third Party Information”). Survey Junkie does not make any representations or warranties regarding the Third Party Websites and/or the Third Party Information. Please carefully review all policies and terms applicable to the Third Party Websites and the Third Party Information.  

Panel and Survey-Related Communications with Survey Junkie

All panel and survey-related communications (excluding personal information) and User Content submitted or transmitted by You to Survey Junkie by electronic mail or otherwise, shall be treated as non-confidential and non-proprietary information, unless specifically indicated by You either prior to, or contemporaneously with, the submission or transmission of such communications and User Content. You agree that any such communications and User Content may be used by Survey Junkie for any legal reason.

Disclaimer and Limitation of Liability

YOU EXPRESSLY AGREE THAT YOUR USE OF THE WEBSITE AND SERVICES ARE AT YOUR OWN RISK. NEITHER SURVEY JUNKIE NOR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE WEBSITE MAKES ANY REPRESENTATIONS ABOUT THE SUITABILITY OF THE CONTENT OF THIS WEBSITE FOR ANY PURPOSE, NOR THAT YOUR USE OF THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE. Limitations of Liability

EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAWS, YOU ACKNOWLEDGE AND AGREE THAT IN NO EVENT WILL SURVEY JUNKIE BE LIABLE, OR OTHERWISE RESPONSIBLE, TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL AND/OR PUNITIVE DAMAGES, FOR ANY REASON(S) OR FOR ANY CAUSE(S), REGARDLESS OF WHETHER SURVEY JUNKIE IS INFORMED OF THE POSSIBILITY THE SUCH DAMAGES MAY EXIST. NOTWITHSTANDING ANYTHING IN THESE TERMS TO THE CONTRARY, THESE LIMITATIONS OF LIABILITY DOES NOT APPLY IN NEW JERSEY.

Compliance with Applicable Laws

You acknowledge and agree that you will comply with all applicable international, national, Federal, state, and/or local laws, codes, regulations, rules and/or requirements (“Applicable Laws”) regarding your use of, participation, in, and/or access to the Services. 

Suspension, Termination and De-Activation of Panel Membership Accounts

Either party may terminate your membership with a Panel at any time, with or without cause, for any reason or no reason, and without liability for the termination.

In addition to any and all other available remedies, Survey Junkie may, without notice, suspend and/or terminate your use of, access to, and/or participation in the Services if you are in breach or violation of these Terms. If Survey Junkie terminates your membership due to your breach or violation of these Terms: (i) you forfeit all rights, title, and interest in and/or to all unredeemed rewards, incentives, and/or prizes, effective upon termination; (ii) your membership will immediately be canceled; (iii) your access to, participation in, and use of the Services will immediately cease, and (iv) you will not be allowed to participate in surveys offered through the Services.

In addition, Survey Junkie reserves the right to de-activate your Panel membership account: (a) if your membership account does not remain Active (as defined herein); (b) if Survey Junkie receives a hard bounce or delivery failure notice in regards to email communications sent by Survey Junkie to your email account; or (c) if Survey Junkie receives a “mailbox full” reply notice three (3) times in regards to email communications sent by Survey Junkie to your email account. For the purpose of these Terms, “Active” means that you: (i) participate in a survey, at least, once every twelve (12) months.

In the event of deactivation, termination by you, or termination by Survey Junkie (other than for your breach or violation of these Terms), Survey Junkie shall maintain unredeemed rewards, incentives, and/or prizes active and available for you to redeem for a period of thirty (30) days following de-activation or termination.

Survey Junkie, Vendor and Subcontractor Employees

  1. Restriction. Survey Junkie, vendor and subcontractor employees and their Immediate Family Member(s) (as defined herein) are not eligible to receive any payments, prizes, or incentives for using, participating in, or accessing the Services. For the purpose of this Section 20, the term “Immediate Family Member(s)” includes parents, spouses, children or significant others (i.e. girlfriends/boyfriends, domestic partners, civil partner and spousal equivalents). 
  2. Procedures. Survey Junkie, vendor and subcontractor employees may use, access, or participate in the Services, only after receiving permission from their respective manager, and only for the sole purpose of improving Survey Junkie's products and/or services. Survey Junkie, vendor and subcontractor employees must always be honest and report accurate information in connection with using, accessing, or participating in the Services. If altered, false, or untrue information or data must be used, prior consent and approval must be received from Survey Junkie's Chief Executive Officer. 
  3. Improper Conduct. Unless authorized pursuant to these Terms or otherwise approved in writing by Survey Junkie' Chief Executive Officer, the violation of the terms of this Section 20 by an Survey Junkie, vendor or subcontractor employee and/or its Immediate Family Member(s) is a violation of Survey Junkie's standards of conduct and any such violation may subject the employee to discipline, including, without limitation, termination of employment. 

Notices

  1. Notice from You to Survey Junkie. Except as otherwise set forth herein, or as required by Applicable Laws, all notices to be sent or provided to Survey Junkie should: (i) be correctly addressed to the applicable business address, and shall be sufficiently delivered if delivered: (a) by Federal Express, Express Mail, or other nationally or internationally recognized overnight courier service (in which case notice shall be effective one (1) business day following dispatch); or (b) by certified mail, return receipt requested, postage prepaid (in which case notice shall be effective six (6) days following deposit in mail); or (ii) be sent via email to the appropriate member services team.
  2. Notice from Survey Junkie to You. Except as otherwise required by Applicable Laws, you agree that Survey Junkie may provide notices to you: (i) via the e-mail address provided by you to Survey Junkie (in which case notice shall be effective one (1) day following the date the e-mail was sent, provided that Survey Junkie did not receive an error message stating that delivery of the e-mail was delayed, that the e-mail address was invalid, or that the e-mail otherwise could not be delivered).
  3. Legal Notice. All questions regarding these Terms and all legal notices should be sent, in accordance with Section 21.A. of these Terms, to:

Electronic Signatures and Agreements

You acknowledge and agree that by clicking on the button labeled "SUBMIT", "GET STARTED", “I AGREE”, or “I ACCEPT" or such similar links as may be designated by Survey Junkie to accept the terms and conditions of these Terms, you are submitting a legally binding electronic signature and are entering into a legally binding contract. You acknowledge that your electronic submissions constitute your agreement and intent to be bound by these Terms and Conditions. Pursuant to any applicable statutes, regulations, rules, ordinances or other laws, including without limitation the United States Electronic Signatures in Global and National Commerce Act (the “E-Sign Act”) or other similar statutes, YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS AND OTHER RECORDS AND TO ELECTRONIC DELIVERY OF NOTICES, POLICIES AND RECORDS OF TRANSACTIONS INITIATED OR COMPLETED THROUGH THE SITE OR SERVICES OFFERED BY SURVEY JUNKIE. Further, you hereby waive any rights or requirements under any statutes, regulations, rules, ordinances or other laws in any jurisdiction which require an original signature or delivery or retention of non- electronic records, or to payments or the granting of credits by other than electronic means.

Severability

If any term or provision of these Terms shall be held or declared to be invalid or unenforceable for any reason by any court of competent jurisdiction, such term or provision shall be deemed null and void and shall not affect the application and/or interpretation of these Terms. The remaining terms or provisions of these Terms shall continue in full force and effect, as if the invalid or unenforceable term or provision was not a part of these Terms. 

Arbitration

ANY CLAIM OR DISPUTE RELATING IN ANY WAY TO YOUR USE OF THE WEBSITE, SERVICES AVAILABLE ON THE WEBSITE, OR THESE TERMS OF USE SHALL BE SUBMITTED TO CONFIDENTIAL ARBITRATION, except that either party may seek interim relief from any state or federal court in the party's state of residence to protect the party's intellectual property rights. ARBITRATION WOULD REMOVE YOUR RIGHT TO LITIGATE A CLAIM IN COURT OR TO HAVE A JURY TRIAL ON THAT CLAIM. OTHER RIGHTS THAT YOU WOULD HAVE IN COURT MAY NOT BE AVAILABLE IN ARBITRATION. IT IS IMPORTANT THAT YOU READ THIS PROVISION CAREFULLY BEFORE ACCEPTING THESE TERMS OF USE.

IF A DISPUTE IS ARBITRATED, YOU GIVE UP YOUR RIGHT TO PARTICIPATE AS A CLASS REPRESENTATIVE OR CLASS MEMBER ON ANY CLASS CLAIM YOU MAY HAVE AGAINST SURVEY JUNKIE INCLUDING ANY RIGHT TO CLASS ARBITRATION OR ANY CONSOLIDATION OF INDIVIDUAL ARBITRATIONS. DISCOVERY AND RIGHTS TO APPEAL IN ARBITRATION ARE GENERALLY MORE LIMITED THAN IN A LAWSUIT, AND OTHER RIGHTS AVAILABLE IN COURT MAY NOT BE AVAILABLE IN ARBITRATION.

All disputes between you and Survey Junkie, including disputes related to this Agreement, your use of the Website, and/or rights of privacy and/or publicity, will be resolved by binding, individual arbitration under the American Arbitration Association's rules for arbitration of consumer-related disputes and you and Survey Junkie hereby expressly waive trial by jury. You may bring claims only on your own behalf. Neither you nor Survey Junkie will participate in a class action or class-wide arbitration for any claims covered by this Agreement. You also agree not to participate in claims brought in a private attorney general or representative capacity, or consolidated claims involving another person's account. This dispute resolution provision will be governed by the Federal Arbitration Act. Judgment on the award rendered by the arbitrator may be entered in any court having competent jurisdiction.

In any arbitration, Survey Junkie will pay the filing, administration, service or case management fee, plus the costs associated with the first day of arbitration, with the remaining costs to be paid by the non-prevailing party. Unless inconsistent with applicable law, each party shall bear the expense of their respective attorneys', experts' and witness fees, regardless of which party prevails in the arbitration.

Arbitration shall take place in Los Angeles, California, but may proceed telephonically if the complainant so chooses.

Governing Laws, Jurisdiction and Venue

This Agreement shall be governed and enforced by applicable laws of the State of California (without regard to conflict of law provisions thereof).

Taxes

You agree that you are responsible for all taxes and fees associated with your use of the Survey Junkie Website and Service. If you earn more than a certain amount of money on the Website, we may be required by law to mail you a form to obtain your social security number for tax reporting purposes. You agree that you will complete and return all forms we send to you requesting information.

Relationship between You and Survey Junkie

You shall be an independent contractor and not a partner, joint venturer, or employee of Survey Junkie. You shall not represent that you are an agent or representative of Survey Junkie.

No Assignment

You may not assign your rights or obligations under this Agreement to any other party without our prior written consent. We may assign our rights and/or obligations under this Agreement to any other party at our discretion.

Miscellaneous Terms

The headings contained in these Terms are for reference only and shall have no effect on the interpretation and/or application of these Terms. Survey Junkie's failure to enforce a breach by you of these Terms shall not waive or release you from such breach and shall not waive, release or prevent Survey Junkie from enforcing any subsequent breach by you of these Terms. These Terms, any rules, terms or policies referenced herein or incorporated herein, and any Panel specific requirements, represent the entire understanding and agreement between Survey Junkie and you with respect to the subject matter hereof.

If parts of these terms and conditions are illegal, unenforceable, or void, the remainder will remain unaffected and enforceable. The Terms stated therein outline the mutual agreements between us. The failure of Survey Junkie to exercise or enforce any right or provision of the Agreement shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Survey Junkie in writing. The section titles in the Agreement are used solely for the convenience of the parties and have no legal or contractual significance.
