Introduction

This is the Privacy and Cookies Policy for the UK and EEA operations for Survey Junkie (the “Privacy Policy”). It applies to the information you provide when you use any of our services, including:

  • when you visit SurveyJunkie.com or any other website owned or controlled by us (the “Website”).
  • when you participate in any online survey or focus groups, sweepstakes or promotions (“Surveys”).
  • when you download, use, access and/or enable mobile, desktop, and browser applications on any device, including browser extensions, desktop applications and Android or iOS mobile applications (“SJ Pulse Applications”).

When we refer to all of these services together, we refer to the “Services”.

Who we are

The Services is an online market research community that is owned and operated by DISQO, Inc. (www.disqo.com). “DISQO” or “Survey Junkie” or “Our” or “Us” or “We” refers to DISQO, Inc. and its subsidiary and affiliated companies. For the purposes of United Kingdom and European Economic Area data protection law (“Data Protection Law”), the data controller is: DISQO Inc, 400 N. Brand Blvd, 6th Floor, Glendale, CA 91203.

What we do

DISQO offers a market research, consumer insights, and analytics platform that sells and delivers data and analytics to the market research industry and various business clients. We believe consumers like you deserve better products and services, and we built Survey Junkie to help you share information with brands and market researchers, so they better understand consumers.

Protecting your Privacy

We are committed to protecting your privacy and ensure that we do so at all times in line with Data Protection Law. This Privacy Policy explains how we collect, use, and share your information when you use our services and your rights with respect to this information.

Please read this policy carefully to understand our information practices. By using our Services, you are agreeing to the practices described in this Privacy Policy.

Information we collect about you

We will collect and process the following personal data from you:

  • Information when you first register for the Services: When you first register for the Services, we request your email address and some basic information about you to generate a basic profile (“Basic Profile”). This information includes your name, post-code and age. If you use services like Facebook or Google to sign up, those services may share some of the information that you have provided to them with us. As part of our verification process, we may take steps to confirm the validity of your email address that you provide as part of registration. This is required in order for us to provide our services and for you to participate in the Services.
  • Information when you register to participate in Surveys: Once you have completed registration, we collect further information from you to create a profile that can be used for participation in Surveys (“General Profile”). For this process, we collect additional information via our inquiry and registration forms.

  • When you register and participate in Surveys, you may be asked for your personal opinions, as well as demographic information, such as your age, gender, income, occupation, and household composition.

    In addition, you may be asked to voluntarily provide “Special Category Data” – this is information that discloses or reveals sensitive information such as your race and ethnic origin. We use these profile answers to match users to the survey's target audience.

    You may of course refuse to answer these or any other questions or discontinue participation at any time.

    You may be asked to provide information about your identity such as a photo, video, a copy of a valid government-issued photo identification (ID) card or document, or a combination thereof. We share this information with third-party identity verification companies to verify your identity and prevent fraud. However, we do not sell or share this information to other third parties for any other purpose. You may refuse to provide this information at any time and choose an alternative method of verification.

  • Information regarding your participation in Surveys: We use your General Profile information to match you with appropriate Surveys from our survey list. Your Survey options are displayed to you on your Profile page within the Services and we receive information whenever you take a Survey.

  • Note that when you click on a Survey, you will be taken to the third-party website where the Survey is hosted. Your personal data will then be processed by that site in accordance with their own privacy notice and we will not be responsible for that aspect of the processing (nor will we see personal data input into the Survey – this is an entirely separate activity). You will be redirected back to the Services once you have completed the Survey, and we will be notified from the third-party survey provider as to the completion-status of the Survey.

  • Information required for redemption of points: If you redeem points, we may ask you to provide information to transfer rewards to your PayPal account. The information requested may include PayPal email address, bank account holder's name, bank account number, bank sort code, and bank account type. If you earn more than a certain amount of money with Survey Junkie, we may be required to obtain further information from you for government tax reporting purposes (you will be contacted with a relevant request if this applies). The required payment processor may change and, therefore, the foregoing would apply to such payment processor and your account with such third-party provider.
  • Information you give us as part of general use of the Services: This is information about you that you give us directly when you interact with us as part of your general use of the Services.
  • This is information about you that you give us by filling in forms within our Services or by corresponding with us by phone, email or otherwise. It includes information you provide when you register to use our Services, search for a product, participate in discussion boards or other social media functions on or via our Services, enter a competition, promotion or survey, submit a query, and when you report a problem with our Services.

    The information you give us may include your name, address, email address and phone number, financial and credit card information, personal description and login and password details.

  • Information passively collected from your use of our Services: We may automatically collect information from you in the event you visit our Website. This includes:
    • Technical information
    • Information about your visit
    • Digital Fingerprinting
    • Digital Advertising

  • Technical information may include the Internet protocol (IP) address used to connect your computer to the Internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform.

    Digital Fingerprinting. Generally, digital fingerprinting assigns a unique identifier to your device or computer based upon the device's or computer's technical settings, characteristics, and IP Address. We use digital fingerprinting technology for quality control and validation purposes and fraud detection and/or prevention, including, but not limited to, identifying duplicate or fraudulent respondents.

    Digital Advertising. We allow third-party companies to collect certain non-personally identifiable information when you visit our website. These companies may use cookies, pixels, or other technologies to collect and use non-personally identifiable information collected during your visits (to this and other websites) to provide advertisements about goods and services likely to be of interest to you. This is known as interest-based advertising, and the data used may include hashed and/or encrypted data, clickstream information, browser type, time and date, and subject of advertisements clicked or scrolled over.

  • Response and feedback information from you via the Google Play Store: Information you provide when you leave feedback and a review via the Google Play Store. This may be reviewed and, where appropriate, responded to by a member of our Customer Care Team.
  • Information we receive from other sources. This is information we receive about you:
    • If you use any of the other websites or apps we operate or the other services we provide.
    • From third parties we work closely with, including the providers of Surveys.
  • In this case we will have informed you via this policy (and, if appropriate, at regular intervals when we collected that data) if we intend to share your data internally and combine it with data collected on this site. We will also have told you for what purpose we will share and combine your data.

    We are working closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, and search information providers). We will notify you when we receive information about you from them and the purposes for which we intend to use that information.

Cookies and other technologies

Cookies are small information packets sent to and stored by web browsers. We use both session cookies and persistent cookies. Session cookies expire when you close your browser. Persistent cookies remain on your device or computer indefinitely until deleted.

We may use session and persistent cookies for several purposes including, without limitation, to provide a better Survey experience, for quality control, for validation, to enable or facilitate Survey participation, tracking of completed Surveys or other completed actions, and for fraud detection and/or prevention.

Cookies help us recognize your browser and capture and remember certain information that you previously shared with us, such as your setting preferences. Most browsers allow you to refuse to accept cookies through browser settings. However, you must have cookies enabled on your browser to use our Services. How we use your information

We believe consumers like you deserve better products and services, and we built Survey Junkie and the Services to help you share information with brands and market researchers. DISQO sells and shares this information to our clients so they better understand consumers.

Additionally, we may also use information collected through the Services for the following reasons:

  • to communicate with you regarding your registration or participation in a Survey or Surveys, the SJ Pulse Applications, our Website, or any sweepstakes or promotions;
  • to tailor Survey opportunities and the displays on the Services to you and send notifications of these opportunities to you;
  • to comply with any legal obligations, including, without limitation, tax obligations and data suppression obligations;
  • to administer and manage our reward and incentive programs and fulfil your requests for rewards and incentives;
  • to update our records;
  • for identity verification and fraud detection and prevention purposes;
  • to help DISQO's clients understand online user behaviour; and
  • as otherwise permitted under this Privacy Policy or as otherwise authorised by you.

Our promotional updates and communications

Where permitted in our legitimate interest or with your prior consent where required by law, we will use your personal data for marketing analysis and to provide you with promotional updates and communications about our products and services.

Closing your Survey Junkie Account

If you want to delete or permanently opt out of your Survey Junkie account, write to Customer Service by selecting “contact us” on our help page. Your account cannot be reinstated once it has been deleted and you will lose any unredeemed points. If your membership has been permanently deleted, but you wish to become a member of Survey Junkie again (to use the Services and participate in Surveys), you will need to sign up with a different email address.

If you only want to opt out of your participation in the SJ Pulse Applications, you can disable and delete the specific SJ Pulse Applications technology you are using as described below:

  • If you are participating in SJ Pulse Applications using a PC, and if you have downloaded and installed the SJ Pulse Applications on your desktop, you can uninstall it through various methods described by Microsoft here.
  • If you are participating in SJ Pulse Applications using our Chrome browser extension, you can uninstall the extension using instructions found here.
  • If you are participating in SJ Pulse Applications via our Android mobile application, you can uninstall the application using instructions found here.
  • If you are participating in SJ Pulse Applications using a Mac, and if you have downloaded and installed the SJ Pulse Applications on your desktop, you can uninstall it through various methods described by Apple here.

Who we give your information to

We may give your information to:

  • Any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, who support our processing of personal data under this policy;
  • DISQO's clients who offer Surveys in accordance with our business model; and
  • Other selected third parties.

Our selected third parties may include:

  • Organisations who process your personal data on our behalf and in accordance with our instructions and Data Protection Law. This includes in supporting the services we offer through the Services, in particular those providing website and data hosting services, providing fulfilment services, distributing any communications we send, supporting or updating marketing lists, facilitating feedback on our services and providing IT support services from time to time. These organisations (which may include third party suppliers, agents, sub-contractors and/or other companies in our group) will only use your information to the extent necessary to perform their support functions.
  • Advertisers and advertising networks that require the data to select and serve relevant adverts to you and others. We do not disclose information about identifiable individuals to our advertisers, but we will provide them with aggregate information about our users. We may also use such aggregate information to help advertisers reach the kind of audience they want to target. We may make use of the personal data we have collected from you to enable us to comply with our advertisers' wishes by displaying their advertisement to that target audience and subject to the cookie section of this policy.
  • Analytics and search engine providers that assist us in the improvement and optimisation of our site and subject to the cookie section of this policy (this will not identify you as an individual).
  • Business partners who provide services and with whom we have entered into agreements in relation to the processing of your personal data, including authorised agents, vendors, subcontractors, clients, and partners, who provide services, including, without limitation, data append services, data validation services, identity verification services, fraud detection and/or prevention services, database-matching services, coding services, data segmentation services, payment processors, reward- and incentive-related services, and market research partners that provide Surveys.
  • Payment processing providers who provide secure payment processing services. Note your payment card details are not shared with us by the provider.
  • We will disclose your personal data to third parties:

  • In the event that we sell or buy any business or assets, in which case we will disclose your personal data to the prospective seller or buyer of such business or assets subject to the terms of this Privacy Policy.
  • If DISQO or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.
  • If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of supply terms and other agreements with you; or to protect the rights, property, or safety of DISQO, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction and to prevent cybercrime.

Where we store your information

The data that we collect from you may be transferred to and processed in locations outside the European Economic Area ("EEA").

Where your information is transferred outside the EEA, we take all steps reasonably necessary to ensure that your data is subject to appropriate safeguards, such as relying on a recognized legal adequacy mechanism, and that it is treated securely and in accordance with this Privacy Policy.

We may transfer your personal data outside the EEA:

  • In order to store it
  • In order to enable us to provide goods or services to you and fulfil our contract with you. This includes order fulfilment, processing of payment details, and the provision of support services.
  • Where we are legally required to do so.
  • In order to facilitate the operation of our group of businesses, where it is in our legitimate interests and we have concluded these are not overridden by your rights.

In particular we may transfer your personal data to the US, to enable third parties such as PayPal and Salesforce to provide us with their services and to support your use of the Services. Where we do this, we enter into the standard UK or EU-approved transfer clauses to ensure the continuing protection of your personal data abroad.

Child safety

Protecting the safety of children when they use the Internet is important to us.

Our Services is not intended to be used by individuals under eighteen (18) years of age, and we do not knowingly collect personal data from anyone under the age of 18. If we become aware that we inadvertently collected personal data from anyone under this age, we will delete such personal data. Parents, guardians, or other persons with parental rights should contact us if they believe that we have collected personal data from anyone under the age of 18.

By using the Services, you confirm to us that you are over 18.

Payment processing

Payments made on the Services are made through our payment gateway provider, PayPal. You will be providing credit or debit card information directly to PayPal which operates a secure server to process payment details, encrypting your credit/debit card information and authorising payment. Information which you supply to PayPal is not within our control and is subject to PayPal’s own privacy policy and terms and conditions.

How we protect your information

All information you provide to us is stored on our secure servers. Any payment transactions will be encrypted. Where we have given you (or where you have chosen) a password which enables you to access certain parts of our Services, you are responsible for keeping this password confidential. We ask you not to share a password with anyone. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

Our site contains links to external sites. We are not responsible for the privacy policies or the content of such sites.

How long we keep your information

We retain personal data for as long as you have an account with us in order to meet our contractual obligations to you and for a reasonable period of time after that to identify any issues and resolve any legal proceedings. We may also retain aggregate information beyond this time for research purposes and to help us develop and improve our services. You cannot be identified from aggregate information retained or used for these purposes..

Your rights

You have the right under certain circumstances:

  • to be provided with a copy of your personal data held by us;
  • to request the rectification or erasure of your personal data held by us;
  • to request that we restrict the processing of your personal data (while we verify or investigate your concerns with this information, for example);
  • to object to the further processing of your personal data, including the right to object to marketing (as mentioned in 'OUR PROMOTIONAL UPDATES AND COMMUNICATIONS' section); and
  • to provide your personal data in a common format that can be transferred to a third party.
  • You can also stop all information collection by un-installing the SJ Pulse Applications. You may use the standard un-install processes as may be available for your mobile device.
  • Your right to withdraw consent:

Where the processing of your personal data by us is based on consent, you have the right to withdraw that consent without detriment at any time by contacting us here.

If your request or concern is not satisfactorily resolved by us, you may approach your local data protection authority (see LINK ). The Information Commissioner is the supervisory authority in the UK and can provide further information about your rights and our obligations in relation to your personal data, as well as deal with any complaints that you have about our processing of your personal data.
